EVENSIDE MATCH — Terms of Sale
1. Who you are buying from
1.1. EVENSIDE MATCHES are sold by EVENSIDE.GG LIMITED, a company registered in England and Wales under company number 16900383, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ (“EVENSIDE”, “we”, “us”). You can reach us at support@evenside.gg, and about your data at privacy@evenside.gg.
1.2. An EVENSIDE MATCH is a match we run ourselves: we hire the pitch, set the price and sell the seats. In the App it carries a white EVENSIDE MATCH pill.
1.3. These Terms of Sale cover the seat you buy. Your EvenSide account and your use of the App stay under our Terms of Service, Privacy Policy and Community Guidelines. If these Terms of Sale and the Terms of Service say different things about an EVENSIDE MATCH, these Terms of Sale apply. Our Cancellation & Refund Policy is about cost-shared matches and does not apply to your seat: section 5 below does.
1.4. You must be 18 or over to buy a seat, as for everything on EvenSide.
2. What you are buying
2.1. A seat — your place as a player — in one EVENSIDE MATCH, on the date, at the time and at the venue shown in the App when you buy it.
2.2. Your seat is for you. You cannot sell it, pass it on, or send someone else to play in your place.
2.3. We may move the match to another pitch at the same venue. We may change the format or number of places before the match confirms; we never change the seat price. Any bigger change — another venue, another day or another kick-off time — we treat as cancelling the match, and everyone is refunded in full (section 5.4).
3. The price
3.1. Before you pay, the App shows you the seat price (which we set for each match), the service fee, and the total. The total is what you pay.
3.2. The service fee is the same fee as on other matches. Membership and Flash Interview discounts apply to it as usual. Discounts never change the seat price.
3.3. The whole payment is ours. There is no organiser on an EVENSIDE MATCH, and no part of your payment goes to another player.
3.4. EVENSIDE.GG LIMITED is not registered for VAT, so no VAT is charged. If that changes, the prices shown will include VAT.
3.5. All prices are in pounds sterling (GBP).
4. Paying
4.1. You pay by card, Apple Pay or Google Pay, through our payment processor, Stripe.
4.2. When you pay, your card is held for the total and nothing is taken yet. We take the payment when the match confirms: the first moment, at or after the match’s refund cutoff, that enough players have joined and paid. The match screen shows how many players are needed and the decision time. If you join after the match has confirmed, your payment is taken straight away.
4.3. If you join more than 7 days before kick-off, you get a place without paying yet, and we ask you to pay once the match is within 7 days. If you have not paid by the refund cutoff, your place is released.
4.4. Your payment and its receipt show in the App’s payment history.
4.5. If a match is full and its waitlist is open, you can join it. Joining it buys nothing and costs nothing: no card is held and nothing is taken. When a place opens, we offer it to the next player on the waitlist for a limited time, shown with the offer. If they do not take it in that time, it passes to the next player in line. We may close a match’s waitlist at any time. If we do, everyone on it is taken off the waitlist, and an offered place that has not yet been confirmed to you is withdrawn: any card hold made for it is released in full and nothing is taken. You buy an offered place at the same seat price and service fee as a seat you book directly (section 3), after accepting these Terms of Sale (section 9), and sections 4 and 5 apply to it as to any seat: your card is held or charged as section 4.2 says, and once the match has confirmed, your seat cannot be given up or passed on (section 5.3). If you are next in line when a place opens more than 7 days before kick-off, it is held for you as a reservation under section 4.3, and you pay for it as that section says.
5. Cancellations, refunds and no-shows
5.1. No 14-day cooling-off period. The law usually gives you 14 days to change your mind about something you buy online. That right does not apply here, because a match is a leisure service on a fixed date (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulation 28(1)(h)). Your rights to leave and to a refund are the ones in this section, and nothing here affects your other statutory rights.
5.2. Before the match confirms, you can leave at any time, free. Your card hold is released in full, service fee included, and nothing is taken. You leave from the match screen in the App.
5.3. Once the match has confirmed, your seat is sold. It cannot be given up or passed on to another player, and you are not refunded if you cannot come.
5.4. If we cancel the match, for any reason, everyone is refunded in full — seat price and service fee. That includes when the venue cancels the booking or closes the pitch, and when something outside our control, such as severe weather or a public-health emergency, stops the match going ahead. We tell everyone in the match through the App.
5.5. If the match does not reach its minimum. Every EVENSIDE MATCH needs a minimum number of players, shown on the match screen with its decision time. If it has not confirmed by then, it is cancelled automatically: every card hold is released in full and nobody is charged.
5.6. No-shows. If you do not turn up, you are not refunded.
5.7. If a match has to stop early. Once a match has kicked off it cannot be cancelled in the App. If it has to stop early — for example the venue closes the pitch, or the weather makes it unsafe — email support@evenside.gg and we will look at it fairly. This does not affect your statutory rights.
5.8. Being removed. We may remove a player from a match under section 6. If we remove you because you broke those rules, you are not refunded. If we remove you through no fault of your own, we refund you in full.
5.9. How refunds reach you. Refunds go back to the card or wallet you paid with, usually within 5 to 10 business days. A released hold is not a refund — no money left your account — but your bank may take 7 to 10 business days to clear it from your statement.
5.10. A problem with a payment? Please email support@evenside.gg before going to your bank. We can usually sort it out faster.
6. Conduct
6.1. Our Community Guidelines and the conduct rules in our Terms of Service apply at every EVENSIDE MATCH, on and off the pitch.
6.2. We, or the person running the match for us, may remove a player who breaks those rules, puts other people at risk, or turns up under the influence of alcohol or drugs.
6.3. Please follow the venue’s own rules and any instruction from its staff.
7. Safety, injuries and our responsibility
7.1. Football is a contact sport and carries a risk of injury, even when everyone plays fairly and the match is well run. Play within your limits, and do not play if you are injured or unwell.
7.2. Because we run this match, we take reasonable care in arranging it: choosing a suitable venue and pitch, setting the format, and following the venue’s safety rules and our own risk assessment for that venue.
7.3. If someone is injured, or there is an incident, at a match we run, we write down what happened the same day. Only our administrators can see that record, and we delete it three years after the incident (later only while a claim or an insurance notice about it is still open). Section 3.12 of our Privacy Policy explains what we record and why.
7.4. If we break these Terms of Sale, we are responsible for loss or damage you suffer that was a foreseeable result of that. Our liability for a match is limited to the total you paid for your seat in it, except where the law does not allow us to limit it.
7.5. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude. Nothing in them affects your statutory rights under the Consumer Rights Act 2015.
7.6. We are not responsible for loss of, or damage to, belongings you bring to the venue, unless it is caused by our negligence.
8. Complaints, contact and the law
8.1. If something goes wrong, email support@evenside.gg. We aim to resolve complaints within 14 business days.
8.2. These Terms of Sale are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts where you live.
8.3. We use your personal data as our Privacy Policy describes.
9. Accepting these Terms of Sale
9.1. Before you pay for a seat, the App asks you to accept these Terms of Sale. We keep a record of your acceptance: who you are, which version of these Terms you accepted (shown at the top of this page) and when.
9.2. We may update these Terms of Sale. The version you accepted when you bought a seat applies to that seat; a new version applies only to seats bought after it is published.
